Section 1-617.07 of the DC Official Code (2001 ed.), provides for the payment of dues by bargaining unit employees and the collection of dues by the Employer.
Consistent with this provision, all employees in a bargaining unit have the right to become dues paying union members of the labor organization that has been certified by the Public Employee Relations Board (PERB) to represent the bargaining unit. Under this provision, if employees in a bargaining unit elect to become union members, they must complete and sign a dues authorization form permitting the DC government to deduct dues from their salaries.
Employees in bargaining units that elect not to become dues paying union members may nevertheless be subject to service fee deductions. Service fees represent a fraction of the dues amount that is attributable to representation activities in line with Hudson v. Chicago Teachers’ Union, Local 1, and related cases.
To initiate the deduction of dues, union representatives must submit the required dues authorization form to OLRCB.
